Employers’ obligations during the lack of water supply

Due to the severe flooding at Severn Trent water treatment works, many people in Gloucestershire are without water. The problem extends to businesses.  Under the Workplace (Health, Safety and Welfare) Regulations 1992, there are certain obligations placed on employers in relation to the provision of water and sanitary conveniences at work.

Suitable and sufficient sanitary conveniences must be provided at readily accessible places.
The toilets should be kept adequately ventilated and lit and should be kept in a clean and orderly condition. In addition, separate rooms containing conveniences should be provided for men and women.

Suitable and sufficient washing facilities must be provided at readily accessible places. 
The washing facilities must be provided in the immediate vicinity of every sanitary convenience and must have a supply of clean hot and cold, or warm, water (which should be running as far as is practicable), together with soap and a suitable means of drying. These facilities should be kept sufficiently ventilated and lit and should be kept in a clean and orderly condition.

Employers must provide an adequate supply of drinking water.
Given the current situation, employers should try as far as possible to meet these requirements, but a pragmatic approach is needed and there is room for some flexibility as many businesses will be attempting to keep their organisations running. 

For businesses that are forced into closing or sending employees home, then it will still be necessary to pay employees as normal (unless there is express provision otherwise in their contracts of employment). Businesses which are able to provide adequate facilities and continue to operate can require employees who do not attend work to make up the time, take it as unpaid leave or use their holiday entitlement. It is essential that businesses adapt a clear and consistent policy, appropriate to the circumstances, and ensure all staff are informed.
