Employment Commentary - 21/3/2010

False Self Employment In Construction

HMRC and HM Treasury have published their comments in relation to the consultation of July 2009 on False Self Employment in Construction.  The idea has been that the Government intend to introduce legislation whereby criteria will be applied to workers in the Construction Industry to determine whether or not they are truly self employed, or whether they are employees masquerading as self employed.

There have been mixed responses and a mixed view from HMRC and the Treasury, but this has been accompanied by some good news for the Construction Industry.  The Government have decided to wait until there is a more solid economic recovery before introducing the legislation into that sector.  Good news then at least in the short term.
